Will you be paying more for cosmetics in 2016?

The answer is yes, if S.1014-Personal Care Products Safety Act sponsored by Senator Dianne Feinstein passes. This bill will require cosmetics companies to pay FDA user fees and will allow states to continue to pass legislation unique to the state, which require specific labeling laws to sell products to consumers in that state, such as Prop. 65 and other state laws, for example that had an affect on companies like Jason Organics. S.1014 will place regulations on the cosmetics industry that are higher than OTC (over the counter drugs) or dietary supplement products.

There is a second bill that offers increased consumer protection without heavy regulations and user fees for the FDA. H.R. 4075 provides national uniformity for cosmetics regulations, which would prevent a state, for example, from imposing specific labeling requirements, for retail sales within that state.

A new study by the Danish Consumer Council THINK Chemicals studied 54 body lotions. Their findings showed 24% of these products available in the Danish market contain ingredients that can either be highly allergenic, or in animal test studies have been shown to impact hormones via the endocrine system, also known as EDC compounds (Endocrine Disrupting Chemicals).

This list includes parabens and cyclopentasiloxane, a silicone commonly found in skin care and anti aging beauty products, which the EU Environment Agency has recently declared “unsafe” and is expected to be banned for use in products.

According to Christel Søgaard Kirkeby, of the Danish Consumer Council THINK Chemicals, “Now there are several reasons why cyclopentasiloxane should not be used in for example body lotions. In part scientists have suspicions that the substance is endocrine disrupting, and in part the Scientific Committee on Consumer Safety does not consider the substance to be safe due to the risk of damage to the liver.”

Your product contains a crystal called a Corundum Crystal. I want you to know that I think the new EpidermxII is AWESOME!! At first I wasn't sure I liked it. Having had problem skin all my life. My skin was always waxy, oily, blemished, and fields of blackheads were a curse I was embarassed to have to bear. Wrinkles and lines began to form at an early age making me look much older than I felt. I was also born with a severe crease in my forehead caused by the muscles in my brow forming too tightly; and I look as if I am in a deep frown all the time-even when I smile. I discussed a remedy with a plastic surgeon and he said I would need to have my entire forehead peeled down, have the muscles examined, and cut them away from the brow. After healing from that they would have to address the remaining impressions in my skin. I was told it may always look like I had a problem there even after they took out the muscle because of how long the skin was folded in that position. With the NaturDerm products I am already smoothing away the lines and making the skin more even. For the first time in my life I have had compliments on my skin. If I eventually can afford to get the surgery to remove the muscles, I am confident that the skin will look like new and I'll be a new man. You literally changed my life, and I am grateful every single day.

Hello! I have had the opportunity to use this product 3 times so far, and so far it seems like a very clean, non-irritating product. I have always had very clear skin, and could probably count on one hand how many blemishes I have had, and I am 35 years old. Until recently. I have Narcolepsy, and was blessed to be able to participate in a clinical trial for a new medication for my illness. The med works great, however, side effects include acne!!! my always dry skin is now an oil slick, and I initially broke out with six blemishes, all over my chin, that lasted for 6 months, and today I still have the remenants of one of them!!I really do like this product. Even though I have just started using it, I do feel and see that my skin is much smoother, and even toned. One of those bad breakouts that seemed to last over six months was still there, and dry. Only with the 3 uses, it is much flatter, and the dryness is much more balanced. That is great all by itself!!! thanks mucho!

More microbead bans on the horizon? 2014 saw the first state, Illinois, to ban microbeads in personal care products. 7 other states followed, NJ, Wisconsin, Indiana, Connecticut, Maine, California, Colorado and the expected addition of New York.

Microbeads can be anything from particle abrasives in exfoliants, soaps, and toothpaste, to polymers in sunscreen products. Usually under 3 mm in size, they can be eaten by marine life and also act as a sponge for chemicals that are present in the water.

They are wreaking havoc with waterways and have been banned as toxic substances by Canada, and recently CIDESCO (Comite International d’Esthetique et de Cosmetologie) has called for its global centers to use natural alternatives to microbeads.

An interesting study out of Plymouth University in the UK, studied “microbeads” which are plastic based polymers used in personal care products such as shampoo, facial scrubs and cleansers.

Released in the Marine Pollution Bulletin, by Professors of Marine Biology, Organic Geochemisty and Analytical Chemisty, PhD student Imogen Napper said, “As the study unfolded I was really shocked to see the quantity of microplastics apparent in these everyday cosmetics. Currently, there are reported to be 80 facial scrubs in the UK market which contain plastic material, however some companies have indicated they will voluntarily phase them out from their products. In the meantime, there is very little the consumer can do to prevent this source of pollution.”

Due to the small size, these particles pass thru sewage filtration systems and there is growing evidence and concern that there is an impact on marine organisms. Electron microscopic analysis showed that each 150 ml (~ 5 oz) of product can contain between 137,000 and 2.8 million micro-particles of plastic, releasing up to 80 tons of microplastic waste into the sea in the UK alone.

Earlier this year, California banned the use of microbeads in products.

Senators Dianne Feinstein (D-California) and Susan Collins (R-Maine) proposed a bill to the Senate Health Committee, called the Personal Care Products Safety Act, that would seek a harmonized cosmetic regulation within the USFDA. Current cosmetic product regulation is by each individual state. It is backed by Personal Care Products Council (PCPC).

According to Michelle Calvarese PhD., a comedogenic ingredient clogs pores by increasing the keratin production in hair follicles. This process can occur quickly, or over a period of months, and is influenced by many factors, including the enzymes and genetics of each person. Human sebum is a comedogenic substance, and avoiding ingredients that are prone to “clogging” is not prevention. Many “comedogenic ingredient” lists online lack scientific testing protocols, however, a common list of tested comedogenic ingredients include:

The extraction process of an ingredient, and combining ingredients can have direct effects on the comedogenicity of a substance, and can turn a non-comedogenic substance into one that is comedogenic. As a result, regulatory guidelines from the FDA do not include of list of comedogenic substances, but merely a definition of a comedogenic ingredient as being one that clogs pores.

An article in beautyhigh.com based upon a panel presentation of MD’s reported this on silicones:

Unless accompanied by a penetration enhancer, silicones stay on top of the skin—and that’s why they feel so great.
“Silicones by themselves just stay on the skin, and that’s why you feel that silky after-feel when you put something on that has silicone,” said a dermatologist. “There are certain things that are penetration enhancers, but I don’t know why you would use [them] unless you’re trying to really drive an active ingredient into the skin.”

Products with silicone feel better—and are more likely to be used.
“I think the silicone issue is a very valid point, because there are biodegradability issues with it, but there’s also one of these other things: people love to have products that feel good,” said a Counsel dermatologist. “Silicones are not all bad; they’re different types of chemical structures. But the silicone question is a big one because you can formulate wonderful products, but if they’re not aesthetically pleasing, your consumer base and your patients will not use them.”

Let’s see, silicones just sit on the skin and prevent active ingredients from being absorbed and have biodegradability issues that these MD’s acknowledged is a valid issue, but not to worry, they have to be used in skin care or customers won’t like the way products feel… Really?
